What is gender self ID?

Gender self-ID, or self-identification, lets a person change their legal gender by making a formal declaration. No medical diagnosis or panel approval is needed. The UK does not use it. Under the Gender Recognition Act 2004, applicants need a diagnosis, evidence of two years living in their gender and approval from a panel.

Under the current system, a trans person can get a Gender Recognition Certificate, which changes their legal sex for most purposes. They need a diagnosis of gender dysphoria, proof of living in their gender for two years and a decision by a Gender Recognition Panel. Fewer than 10,000 certificates have been issued since 2005. A certificate is not needed to live in your gender day to day.

In December 2022 the Scottish Parliament passed a bill introducing self-ID from age 16. The UK government blocked it in January 2023 using a never-before-used power under section 35 of the Scotland Act. A court challenge failed. In April 2025 the Supreme Court ruled that sex in the Equality Act 2010 means biological sex.

Several countries use self-ID, including Ireland, Denmark and Spain. Supporters say the current process is intrusive, slow and treats being trans as an illness. Opponents worry about the impact on women-only spaces, such as refuges, prisons and sports, and about safeguards for young people. The debate remains heated. Supporters of self-ID argue that legal recognition and access to single-sex spaces are separate questions, and that existing laws can protect women.

The view from the left

Much of the left supports self-ID to make legal recognition simpler and less intrusive for trans people.

The view from the right

Much of the right opposes self-ID, arguing it threatens single-sex spaces and that safeguards are needed.
